GENERAL TERMS AND CONDITIONS

2. APPLICABILITY

These terms and conditions apply to every offer made by the Seller and to every agreement concluded between the Seller and the Customer (consumer or professional buyer). By placing an order, the Customer acknowledges having read and accepted these terms and conditions.

3. THE OFFER AND PRICE

  • Offer: If an offer has a limited validity period or is subject to conditions, this will be explicitly stated. For Minerva parts (new, NOS, or used), the condition of the product is described as accurately as possible.
  • Price: All prices are quoted in Euros and include VAT, unless stated otherwise. Shipping costs will be clearly communicated before completing the order.

4. RIGHT OF WITHDRAWAL

  • Right of return: Consumers have the right to withdraw from the agreement within 14 calendar days without giving any reason. This period starts the day after the product is received.
  • Exceptions: The right of withdrawal does not apply to:
    • Parts specifically manufactured or customized for the customer.
    • Reconditioned parts showing wear after installation.

  • Costs: The costs for returning goods are borne by the Customer, unless the product was delivered defective.


5. WARRANTY AND CONFORMITY

  • Statutory warranty: In accordance with Belgian law, consumers benefit from a statutory warranty of 2 years on new goods for any lack of conformity existing at the time of delivery.
    Second-hand/New Old
  • Stock: For second-hand goods, a warranty period of 1 year can be agreed. Due to the nature of Minerva parts (classic cars), defects caused by normal wear or incorrect installation are not covered.
  • Reconditioning: : Reconditioning work performed by the Seller carries a specific warranty of 3 months, limited to the work carried out and the replaced parts. The warranty is void if the part is opened or modified by the Customer or third parties.

6. LIABILITY

The Seller is not liable for indirect damage, consequential damage (such as towing costs, labor of external garages, or loss of profit), or damage caused by misuse, overheating, or incorrect installation of the parts. Total liability is always limited to the invoice amount of the delivered part.

7. DELIVERY AND PERFORMANCE

8. PAYMENT

Orders will only be processed after receipt of payment via the payment methods offered on the website.

9. COMPLAINTS AND DISPUTES

  • Complaints: Complaints regarding the execution of the agreement must be submitted to the Seller in a timely, complete, and clearly described manner via info@minervatempoland.com.
  • Applicable law: All agreements are governed exclusively by Belgian law.
  • Competent court: In case of disputes, the courts of the jurisdiction where the Seller is located (Kortrijk) have exclusive competence.
  • ODR-Platform: Consumers can also use the Online Dispute Resolution platform of the European Commission: http://ec.europa.eu/odr
